Section 1

Agreement to Terms

By accessing our website at nmprofessionalhairproducts.co.za (or nm-hair.vercel.app) and purchasing our products, you agree to be bound by these Terms and Conditions. These terms are governed by the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), and all other applicable South African legislation. If you do not agree to these terms, please do not use our website or purchase our products.

Section 2

Products & Pricing

• All prices are displayed in South African Rand (ZAR) and include VAT where applicable
• Prices are subject to change without notice, but will never change after an order has been confirmed
• Product images are for illustrative purposes. Actual products may vary slightly in appearance
• We reserve the right to limit quantities of any product per order
• Products are subject to availability. We will notify you if an ordered item is out of stock

Section 3

Orders & Payment

• An order is confirmed only after successful payment processing
• We accept Visa and Mastercard debit and credit cards via Stripe's secure payment platform
• Stripe is PCI-DSS Level 1 certified. Your card details are never stored on our servers
• You will receive an email confirmation within 30 minutes of a successful order
• We reserve the right to cancel any order at our discretion, with a full refund issued within 5 business days
• In accordance with the ECT Act, you have the right to cancel an electronic transaction within 7 days of receipt

Section 4

Shipping & Delivery

• We currently ship within South Africa only
• Orders are processed within 1–2 business days of confirmed payment
• Standard delivery takes 2–5 business days depending on your location
• Free shipping applies to all orders over R750
• Orders below R750 attract a flat shipping fee of R85
• Shipping timeframes are estimates and are not guaranteed. Delays may occur during public holidays
• Risk of loss passes to you upon delivery to the address provided at checkout
• If a delivery fails due to an incorrect address, re-delivery costs are at the customer's expense

Section 5

Returns & Refunds

In accordance with the Consumer Protection Act (CPA), you have the following rights:

• You may return any unopened, unused product in original sealed packaging within 30 days of receipt for a full refund
• Opened or used products cannot be returned for hygiene reasons, unless the product is defective
• If you receive a defective or damaged product, contact us within 48 hours of delivery with photographs and we will arrange a replacement or full refund at no cost to you
• To initiate a return, email nmhairproducts@gmail.com with your order number and reason for return
• Refunds are processed within 3–5 business days of receiving the returned item
• Refunds are issued to the original payment method only
• Return shipping costs are at the customer's expense unless the item is defective or incorrect

Intellectual Property

All content on this website — including but not limited to text, images, logos, product names, and design — is the property of NM Professional Hair and is protected by South African copyright law. You may not reproduce, distribute, or create derivative works without our express written permission.

Section 7

Limitation of Liability

To the maximum extent permitted by South African law, NM Professional Hair shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or products. Our total liability for any claim arising from a purchase shall not exceed the amount paid for that specific order. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.

Section 8

Privacy

Your personal information is collected and processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). By placing an order, you consent to the collection and processing of your personal information as described in our Privacy Policy, which forms part of these Terms and Conditions.

Section 9

Governing Law & Disputes

• These terms are governed by the laws of the Republic of South Africa
• Any disputes arising from these terms or your use of our website shall be subject to the jurisdiction of the South African courts
• We encourage you to contact us first to resolve any dispute informally
• If informal resolution fails, you may refer the matter to the National Consumer Commission (NCC) at thencc.org.za
• Consumer disputes may also be referred to the Consumer Goods and Services Ombud (CGSO) at cgso.org.za

Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our practices or applicable law. The date at the top of this page indicates when the terms were last updated. Continued use of our website after any changes constitutes your acceptance of the new terms.
